North Carolina Seeks Input on Proposed Civil Penalties

Don’t get zapped by potential new civil penalties. The Board of Barber and Electrolysis Examiners proposed new rules (page 15) that would establish potential civil penalties for unlicensed individuals practicing electrology and other related light-based treatments. The rules also suggest possible civil penalties for noncompliant electrology schools.

Penalty for Unlicensed Practice
The proposed rules suggest a civil penalty of $5,000 for an individual engaging in the practice of electrology or laser, light source, or pulsed-light treatments without a license.

School Sanctions
The proposed rules outline new civil penalties for schools.

An individual operating a school of electrology or laser, light source, or pulsed-light treatments without certification could be subject to the following penalties:

  • 1st offense: $300
  • 2nd offense: $400
  • 3rd offense: $500

A school of electrology or laser, light source, or pulsed-light treatments that fails to maintain records could be subject to the following penalties:

  • 1st offense: $200
  • 2nd offense: $250
  • 3rd offense: $500

A school of electrology or laser, light source, or pulsed-light treatments that fails to submit records could be subject to the following penalties:

  • 1st offense: $200
  • 2nd offense: $350
  • 3rd offense: $500

A school of electrology or laser, light source, or pulsed-light treatments that falsifies records could be subject to a penalty of $500.

A school of electrology or laser, light source, or pulsed-light treatments that fails to comply with facility requirements could be subject to the following penalties:

  • 1st offense: $250
  • 2nd offense: $400
  • 3rd offense: $500

A school of electrology or laser, light source, or pulsed-light treatments that fails to comply with required student-instructor ratios could be subject to the following penalties:

  • 1st offense: $250
  • 2nd offense: $400
  • 3rd offense: $500
